Unbiased Medical Opinions

The value of a medical opinion depends entirely on the independence, the expertise, and the integrity of the physician who renders it.

  • “The reliability and validity of Independent Medical Examinations are significantly influenced by the examining physician’s specialty training, structured examination methodology, and adherence to evidence-based diagnostic criteria — factors that vary substantially across examiners.” — Rainville J, et al.

  • “Expert witness testimony in musculoskeletal and spine injury litigation is most credible when rendered by a physician with active clinical practice in the relevant specialty, peer-reviewed publication experience, and demonstrable familiarity with the applicable evidence base.” — American Medical Association.

  • “Second opinion consultations result in a change or refinement of diagnosis in a significant proportion of cases, and in a change in recommended management in an even higher proportion — with direct implications for patient outcomes and avoidance of unnecessary procedures.” — Payne VL, et al.

I. Independent Medical Exam

An Independent Medical Examination — or IME — is a structured, comprehensive evaluation of a patient’s medical condition, functional capacity, and causation history conducted by a physician who has no prior treating relationship with the patient. The IME is a cornerstone of the legal, insurance, and workers’ compensation systems that govern how injury claims, disability determinations, and liability questions are resolved. Its value depends entirely on one thing: the independence, expertise, and intellectual honesty of the examining physician.

Dr. Mahajer conducts Independent Medical Examinations for insurers, employers, defense and plaintiff attorneys, workers’ compensation carriers, and administrative agencies across a broad range of musculoskeletal, spinal, neurological, and pain-related conditions. His evaluations are thorough, his reports are clear, and his opinions are grounded in the published medical literature and current clinical standards — not in the interests of the party that retained him.

A complete IME with Dr. Mahajer includes a comprehensive review of all available medical records, imaging, prior evaluations, and relevant correspondence; a structured clinical interview covering the mechanism of injury, symptom history, treatment history, and functional status; a detailed physical examination of the relevant anatomical regions; and where clinically indicated, musculoskeletal ultrasound or a review of electrodiagnostic studies. The resulting report addresses all questions posed by the referring party with specificity, clarity, and defensible clinical reasoning.

“The reliability and validity of Independent Medical Examinations are significantly influenced by the examining physician’s specialty training, structured examination methodology, and adherence to evidence-based diagnostic criteria — factors that vary substantially across examiners.” — Rainville J, et al. Spine. 2005;30(24):2884–2892.

The questions most commonly addressed in Dr. Mahajer’s IME reports include: the nature and extent of the claimant’s injuries or condition; causation — whether the condition is related to the incident or exposure at issue; the appropriateness and necessity of prior treatment; the appropriateness and necessity of proposed future treatment; maximum medical improvement status; permanent impairment rating using AMA Guides methodology; functional restrictions and work capacity; and apportionment between the subject incident and pre-existing conditions.

His dual board certification in Physical Medicine and Rehabilitation and Sports Medicine, combined with his fellowship training at Mount Sinai and his extensive clinical experience with spine, nerve, musculoskeletal, and pain conditions, positions him as one of the most qualified and credible examiners available for complex injury cases.

Dr. Mahajer provides IME services for both plaintiff and defense matters. His reports are thorough, well-reasoned, and written in a format that is useful for legal and administrative proceedings. He is available for deposition and available to discuss cases directly with counsel. For scheduling and fee information, please contact the office directly.

II. Medical Expert Witness

When medical questions become legal questions — in personal injury litigation, medical malpractice proceedings, workers’ compensation disputes, disability hearings, or administrative matters — the quality of the expert medical testimony presented can determine the outcome. A medical expert witness is not simply a physician who agrees to testify. A credible, effective medical expert is a physician whose qualifications are beyond challenge, whose opinions are grounded in the published literature and current clinical standards, and whose testimony is clear, consistent, and capable of withstanding rigorous cross-examination.

Dr. Mahajer serves as a medical expert witness in matters involving spine injuries, musculoskeletal conditions, nerve injuries, pain disorders, sports medicine, physical medicine and rehabilitation, and related areas. His opinions address questions of diagnosis, causation, standard of care, treatment necessity, functional capacity, and prognosis — always grounded in the best available evidence and stated with the degree of medical certainty that the proceeding requires.

His credibility as an expert witness rests on a foundation that is genuinely difficult to challenge. He is double board-certified in PM&R and Sports Medicine by the American Osteopathic Board. He completed fellowship training in Interventional Spine and Sports Medicine at one of the country’s leading academic medical centers. He has been recognized as a Top Doctor and America’s Best Doctor. He has published peer-reviewed research, contributed book chapters to Oxford University Press, Human Kinetics, and Springer, and lectured at national and international conferences. He practices clinically every day in the conditions about which he testifies — his opinions are not academic; they are grounded in active, current clinical experience.

“Expert witness testimony in musculoskeletal and spine injury litigation is most credible when rendered by a physician with active clinical practice in the relevant specialty, peer-reviewed publication experience, and demonstrable familiarity with the applicable evidence base.” — American Medical Association. Code of Medical Ethics Opinion 9.7.1. 2016.

Dr. Mahajer prepares thoroughly for every matter in which he serves as an expert. He reviews all relevant records, imaging, and literature before rendering an opinion. He distinguishes clearly between what the evidence supports and what it does not. He does not overstate certainty or minimize complexity. And he delivers his testimony — whether at deposition or at trial — with the calm, methodical clarity of a clinician who is entirely confident in the science behind his opinions.

Dr. Mahajer accepts expert witness engagements in both plaintiff and defense matters, and is available for case review, written opinion, deposition, and trial testimony. Retainer arrangements and scheduling are handled through the office. Early engagement is recommended for matters with approaching discovery deadlines or trial dates.

III. Second Opinions & Case Reviews

A second opinion is one of the most underutilized tools in medicine — and one of the most valuable. Patients who are told they need surgery, who have received a diagnosis that does not feel right, who have been in pain for months or years without an adequate explanation, or who simply want to be certain before proceeding with a major intervention have not just the right but the responsibility to seek an independent clinical perspective from a qualified physician.

Dr. Mahajer provides second opinion consultations across the full range of conditions within his expertise: spine conditions including disc herniation, stenosis, spondylolisthesis, and degenerative disease; joint conditions including osteoarthritis, rotator cuff tears, and labral pathology; nerve conditions including radiculopathy, peripheral neuropathy, and entrapment syndromes; pain conditions including complex regional pain, fibromyalgia, and chronic myofascial pain; and sports and occupational injuries across all anatomical regions.

A second opinion consultation with Dr. Mahajer is not a perfunctory review. It is a comprehensive, independent evaluation that begins from the beginning — a complete history, a thorough physical examination, a critical review of all prior imaging and records, and an honest, well-reasoned clinical opinion that may confirm, modify, or respectfully disagree with prior assessments. The goal is not to validate or challenge for its own sake. The goal is to give you the most accurate possible picture of your condition and your options so that the decisions you make are fully informed.

“Second opinion consultations result in a change or refinement of diagnosis in a significant proportion of cases, and in a change in recommended management in an even higher proportion — with direct implications for patient outcomes and avoidance of unnecessary procedures.” — Payne VL, et al. J Eval Clin Pract. 2014;20(3):268–274.

For referring physicians and care teams seeking a formal case review — whether for complex diagnostic questions, treatment planning input, pre-operative evaluation, or management of a patient who has not responded to standard care — Dr. Mahajer provides structured case review services that include a written summary of findings and recommendations suitable for inclusion in the medical record and for communication to other members of the care team.

The value of a second opinion or case review depends on the quality and independence of the physician providing it. Dr. Mahajer has no financial relationship with device manufacturers, no incentive tied to procedural volume, and no interest in confirming a recommendation simply because it was made by someone else. His opinion is his own, grounded in the evidence, and delivered with the same directness and integrity that defines his clinical practice.

If you have been told you need surgery and are not certain, seek a second opinion before proceeding. If you have been in pain for months or years without a clear diagnosis, a comprehensive case review may provide the clarity that has been missing. If you have received conflicting recommendations from different providers, an independent evaluation by a physician with Dr. Mahajer’s training and experience can help you make sense of them. You deserve to make the most important decisions about your body and your health with complete information — and a second opinion is how you get it.

PAIN SHOULD NOT DEFINE WHAT YOU ARE ABLE TO DO
